TERMS AND CONDITIONS MALO HOUSE

This document governs the terms and conditions of membership of the membership program "Malo House" (hereinafter, the "Program"), promoted by Malo S.r.l., with registered office at Via Gattinella n. 6, Campi Bisenzio (FI), VAT No. 03473900987 (hereinafter, "Malo").

Membership in the program is free, on a voluntary basis and by means of:

• invite
• through registration on the malo.com website. Use of this option requires that applicants be included in the “Friends of the Brand” status and in the relative waiting list. Each application will be subject to discretionary review by the Malo S.r.l. team, which reserves the right, at its sole discretion, to accept or refuse the application, without any duty of justification.       
• express acceptance of the conditions herein.

Access to purchase of the entire catalog available on the Malo S.r.l. website is exclusively reserved to subjects with active “Member of Malo House” status. Subjects without this status may access purchase of a limited selection of products; this selection will be identified and updated periodically at the discretion of Malo S.r.l.

Malo reserves the right to accept, refuse or revoke membership at its discretion, and in case
of improper use or violation of these conditions.

The membership has a duration of:

•   one year (annual), starting from the activation date;
• membership renewal is not automatic. Malo S.r.l. will send a renewal reminder to the member at least 90 (ninety) days prior to the approaching expiration date, it being understood that any renewal will be subject to a new application and its approval by Malo S.r.l., at its sole discretion.

Malo may change the duration or renewal conditions upon notification of the
member.

Members have access to exclusive benefits, which include:

• Access to the purchase of the entire catalog of products on the site;
• Preview and pre-order of collections;
• Access to the free Malo Forever repair and restoration service for the life of the garment;
• Priority access to our capsule collections and exclusive collaborations;
• Early access to seasonal sales;
• Free shipping and returns.
  

Malo reserves the right to modify, suspend or revoke Program Benefits at any time, without conferring any right to damages, except where provided by the applicable law.

The membership:

• is personal and non-transferable;      
• may not be divested, sold or used for unauthorized commercial purposes.

Malo may suspend or close the account in case of abusive or fraudulent use.

The member may withdraw:

• at any time, by written communication to email: malohouse@malo.com

Malo reserves the right to:

• suspend or revoke the membership with immediate effect in case of violation of the conditions herein.

All content, materials,
experiences and services offered in the context of the Program:

• remain the exclusive property of Malo or third-party licensors;
• may not be copied, reproduced or used without written authorization.

To the extent permitted by law:

• is not liable for indirect damage, loss of opportunity or benefits;
• any liability is limited to cases of willful misconduct or gross negligence.

Malo reserves the right to modify:

• the Program;
• the Terms and Conditions herein.
  

Modifications shall be communicated to members and take effect from the date indicated.

Processing of personal data occurs in compliance with applicable law (GDPR) and according to the privacy disclosure available on official Malo channels.

The conditions herein are governed by Italian law.

For any dispute, the Court of Florence has exclusive jurisdiction, unless otherwise required by law.
